Bergen County DCP&P Investigation for Drug and Alcohol Abuse

H.J. contacted our office after DCP&P opened up an investigation against her and threatened to file a complaint before the Bergen County Superior Court if she refused to cooperate. The Division claimed that H.J. had an uncontrollable substance abuse problem and was unfit to parent her five year old son.  Sadly, DCP&P entered her life because she contacted the police in light of the father’s violent conduct.  Unfortunately, instead of the focusing on the father, DCP&P directed its attention towards her.  The Division began interrogating her and also demanded that she submit to a substance abuse evaluation as well as submit to drug tests.  The Division also insisted that if she did not cooperate, they will proceed to court to obtain a court order.

Nevertheless, H.J. did not have a drug problem and did not believe she should be forced to undergo any form of counseling or tests.  Consequently, she retained our firm for assistance.  Immediately after speaking to H.J., we contacted the Division and clarified the issues.  We were able to show that H.J. was not suffering from any form of substance abuse and most importantly, was more than capable to caring for her son.

As a result, DCP&P did not require her to submit to any evaluation or tests and the case never went to court.  Moreover, after a few months, the case was closed, and all the while, her child remained under her care without any form of restrictions in place.
